These Managed Hosting Terms of Service (“Terms”) govern managed website hosting and related services provided by Advanced Visual Technologies (“AVT,” “we,” “us,” or “our”). By purchasing, using, or renewing an AVT managed hosting service, the customer (“Client,” “you,” or “your”) agrees to these Terms.
1. Managed Hosting Services
AVT provides managed website hosting services that may include website hosting, email hosting, SSL certificates, website management tools, backups, security features, technical support, and other services according to the hosting plan purchased.
Features, storage allowances, email-account limits, database limits, website-management allowances, and other resources vary by plan.
Hosting services are provided using infrastructure, software, data centers, networks, and other services that may be operated by third-party providers.
2. Hosting Plans and Resource Limits
Each AVT hosting plan includes specific storage and account-resource allocations.
Current plans include:
AVT Basic
- 2 GB NVMe storage
- Unlimited bandwidth, subject to reasonable and acceptable use
- Up to 10 email accounts
- Up to 5 MySQL databases
- SSL certificate
- Weekly backups
- Malware and security protection
- Professional hosting support
AVT Standard
- 5 GB NVMe storage
- Unlimited bandwidth, subject to reasonable and acceptable use
- Up to 25 email accounts
- Up to 10 MySQL databases
- SSL certificate
- Weekly backups
- WordPress and Elementor support
- Up to 30 minutes of qualifying minor website updates per month
AVT Pro
- 10 GB NVMe storage
- Unlimited bandwidth, subject to reasonable and acceptable use
- Up to 50 email accounts
- Up to 20 MySQL databases
- SSL certificate
- Weekly backups
- WordPress and WooCommerce compatible hosting
- Priority support
- Up to 60 minutes of qualifying minor website updates per month
AVT may implement reasonable resource restrictions when a website negatively affects server stability, security, network performance, or other customers.
“Unlimited” bandwidth does not mean unlimited server resources or unrestricted use. Hosting accounts may not be used primarily as file repositories, backup-storage services, streaming-media repositories, or for other purposes unrelated to operating the Client’s website.
3. Website Care and Included Update Time
Certain plans include a monthly allowance for qualifying minor website updates.
Qualifying minor updates may include:
- Text changes
- Replacing existing images supplied by the Client
- Updating business hours
- Updating telephone numbers or contact information
- Changing links
- Adding Client-supplied content to existing sections
- Minor Elementor content adjustments
Included website-update time does not roll over from month to month. Unused time expires at the end of each applicable monthly service period.
Requests exceeding the included allowance may require additional charges. AVT will obtain authorization before performing separately billable work.
4. Work Not Included in Website Care
Unless separately purchased or specifically agreed to in writing, managed hosting does not include:
- New page design or development
- Website redesigns
- Major layout or structural changes
- Custom programming
- Custom plugin or application development
- Graphic design or logo creation
- Search engine optimization campaigns
- Advertising or marketing campaigns
- Bulk product or content entry
- Complex WooCommerce development
- Troubleshooting unrelated third-party products or services
- Major functionality changes
AVT may provide a separate estimate for work outside the Client’s hosting or website-care allowance.
5. Billing and Renewals
Managed hosting is offered on monthly or annual recurring billing cycles as selected during checkout.
The Client authorizes AVT and its payment processor to charge the payment method on file for recurring service fees when due.
Unless canceled in accordance with these Terms, hosting service will automatically renew at the end of each applicable billing period.
AVT may change pricing for future renewal periods upon reasonable advance notice. Price changes will not retroactively affect amounts already paid for an existing billing period.
6. Cancellation
Clients may request cancellation through AVT’s designated customer-support or client-account system.
Cancellation does not automatically entitle the Client to a refund for amounts already paid.
Unless otherwise agreed in writing, cancellation becomes effective at the end of the period for which the Client has already paid.
Clients are responsible for obtaining copies of website files, databases, email, and other information they wish to retain before service termination.
AVT may delete data associated with a terminated hosting account after the service ends.
7. Refunds
Because hosting resources and account services are provisioned upon purchase, fees for completed or partially completed service periods are generally non-refundable except where required by applicable law or where AVT expressly agrees otherwise in writing.
No prorated refund is guaranteed for unused portions of monthly or annual hosting periods following a Client-requested cancellation.
If AVT terminates a service for reasons unrelated to Client misconduct, abuse, nonpayment, or violation of these Terms, AVT may provide an appropriate prorated refund or service credit at its discretion.
8. Payments and Nonpayment
Invoices must be paid by their stated due date.
If payment becomes overdue, AVT may suspend hosting or related services after applicable notices or grace periods.
During suspension, websites, email, databases, and other services may become unavailable.
AVT may terminate accounts that remain unpaid. Restoration after suspension or termination may be subject to data availability and applicable restoration or reactivation charges.
9. Backups
AVT’s managed hosting environment includes weekly backups as part of its hosting infrastructure.
Backups are provided as a convenience and disaster-recovery measure and are not guaranteed to contain every file, email, database record, transaction, or website change.
Backup availability and retention may also depend upon third-party infrastructure and backup systems.
Clients with business-critical information should maintain independent copies of important website files, databases, email, business records, and other data.
AVT does not guarantee that any particular backup will be available or fully restorable.
10. Website Migration
AVT may provide website migration assistance for qualifying websites.
Migration scope depends on the website’s size, technology, configuration, access credentials, and compatibility with AVT’s hosting environment.
The Client is responsible for providing accurate and functional credentials necessary to perform a migration.
AVT cannot guarantee that every third-party application, plugin, script, email configuration, DNS configuration, or custom server configuration will transfer without modification.
Unless expressly stated otherwise, AVT does not guarantee zero downtime during migration or DNS changes.
11. Security and Malware
AVT employs hosting-level security technologies intended to reduce the risk of unauthorized access, malicious activity, and malware.
However, no website, hosting platform, network, security product, or monitoring system can guarantee complete protection against hacking, malware, data loss, or other security incidents.
Clients are responsible for maintaining secure passwords and protecting account credentials.
Clients must not knowingly install or maintain compromised, pirated, nulled, malicious, or materially outdated software that creates an unreasonable security risk.
AVT may temporarily suspend or restrict a website when necessary to protect the affected account, AVT infrastructure, other customers, or third parties from an active security threat.
12. WordPress, Plugins and Third-Party Software
Websites may rely on WordPress, Elementor, WooCommerce, plugins, themes, APIs, payment gateways, email providers, and other third-party products.
AVT does not control third-party software developers or service providers and cannot guarantee the continued availability, compatibility, functionality, pricing, licensing, or security of third-party products.
Problems caused by third-party software may require work outside the scope of the Client’s hosting plan.
13. Email Services
Hosting plans may include email accounts subject to the limits of the selected plan.
Email services may not be used for spam, unsolicited bulk email, phishing, malicious attachments, fraudulent activity, or other abusive purposes.
AVT does not guarantee delivery of every email message. Email delivery may be affected by recipient servers, spam filters, reputation systems, DNS configuration, blocklists, third-party networks, and other factors outside AVT’s control.
14. Acceptable Use
Clients may not use AVT hosting services for unlawful, fraudulent, abusive, or malicious purposes.
Prohibited activities include malware distribution, phishing, spam, unauthorized network scanning, denial-of-service attacks, distribution of malicious software, infringement of intellectual-property rights, or activities that materially interfere with AVT infrastructure or other customers.
AVT reserves the right to suspend services when reasonably necessary to investigate or stop prohibited activity.
15. Client Responsibilities
The Client is responsible for:
- Providing accurate account and contact information
- Protecting passwords and credentials
- Maintaining necessary licenses for software and content
- Ensuring that website content complies with applicable laws
- Responding to security and abuse notifications
- Maintaining independent copies of business-critical information
- Providing AVT with appropriate access when support or maintenance is requested
16. Service Availability
AVT strives to provide reliable hosting services but does not guarantee uninterrupted or error-free availability.
Service may occasionally be affected by maintenance, hardware or software failures, network problems, cyberattacks, upstream provider outages, data-center incidents, DNS failures, Internet routing problems, force majeure events, or circumstances outside AVT’s reasonable control.
Scheduled or emergency maintenance may be performed when necessary to maintain security, stability, or performance.
17. Technical Support
Managed hosting includes reasonable technical support for hosting-related matters.
Support scope depends upon the selected hosting plan and the nature of the request.
Hosting support does not automatically include website development, custom programming, SEO, graphic design, marketing, or troubleshooting of unrelated third-party systems.
18. Data and Account Termination
Following cancellation or termination, AVT is not obligated to maintain Client data indefinitely.
Clients should obtain any required website files, databases, email, or other data before their hosting account is terminated.
Once data has been removed from active systems and available backups, recovery may not be possible.
19. Limitation of Liability
To the maximum extent permitted by applicable law, AVT will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use or inability to use the hosting service, including loss of profits, revenue, business opportunities, data, email, search-engine rankings, or goodwill.
To the maximum extent permitted by applicable law, AVT’s aggregate liability arising from a hosting service will not exceed the amount paid by the Client to AVT for the affected hosting service during the six months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
20. Indemnification
To the extent permitted by law, the Client agrees to indemnify and hold AVT harmless from third-party claims arising from the Client’s unlawful content, infringement of third-party rights, misuse of the hosting service, or violation of these Terms.
21. Changes to These Terms
AVT may update these Terms to reflect changes in services, technology, security requirements, business practices, or applicable law.
Material changes will apply prospectively. Continued use or renewal of the service after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by law.
22. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
Any dispute arising from these Terms or AVT managed hosting services will be subject to the jurisdiction of courts having appropriate jurisdiction in Arizona, except where applicable law requires otherwise.
